This Terms of Service (“Agreement”) is a legally binding contract between you (“User,” “Client,” or “you”) and Tradelift(“Company,” “we,” “our,” or “us”), a marketing and automation agency based in Toronto, Ontario, Canada. By accessing or using our website, CRM platform, or communication services, you acknowledge that you have read, understood, and agree to the terms below.

1. Overview

Tradelift provides AI-driven digital marketing and automation services, including but not limited to: creation and optimization of Facebook and Instagram advertising campaigns, AI-powered call and text follow-up systems, CRM automation and calendar integrations, online reputation management (automated 5-star review systems), and marketing strategy and consultation. This Agreement governs your access to our website, communications, and any platform services provided by Tradelift.

2. Acceptance of Terms

By using our services or providing your information (e.g., through a website form, landing page, or ad campaign), you consent to this Agreement. If you do not agree, please do not access or use our services.

3. Client Responsibilities

Clients agree to provide accurate and lawful information, obtain proper consent from any individuals whose data is shared with Tradelift, and use our tools in compliance with applicable privacy, marketing, and advertising regulations. Tradelift is not responsible for violations caused by client misuse of our services.

4. Payments and Billing

Fees are charged according to your service plan. Invoices must be paid on time to avoid service suspension. Payments are non-refundable unless explicitly stated in a written agreement.

5. Communication Consent (Opt-In Policy)

a. Voluntary Opt-In

By submitting your information to Tradelift—such as filling out a form, engaging with a Facebook ad, subscribing to updates, or contacting us through any channel—you are voluntarily opting in to receive communications from us. This may include SMS messages, phone calls, emails, and other automated or personalized messages about your services, appointments, or campaigns. You acknowledge that you are providing this consent freely and by choice, and that no service requires consent to receive marketing messages unless it is necessary for providing requested information or services.

b. Opt-Out Policy

You can opt out of communications at any time, with no penalty or loss of access to services. To opt out: reply STOP to any text message to stop receiving SMS messages; reply HELP for customer support; click “Unsubscribe” at the bottom of marketing emails; or contact us at [email protected] to remove your contact information from all communications. Once you opt out, we will immediately stop sending marketing messages to that communication channel.

c. Legal Compliance

Tradelift’s communication practices comply with Canada’s Anti-Spam Legislation (CASL), Personal Information Protection and Electronic Documents Act (PIPEDA), and U.S. Telephone Consumer Protection Act (TCPA) for A2P messaging. All communications are sent only to users who have freely and explicitly opted in.

6. Limitation of Liability

Tradelift shall not be liable for loss of data, service interruptions, or third-party system errors (e.g., Facebook or GoHighLevel issues). Tradelift shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid for services in the preceding three (3) months.

7. Intellectual Property

All creative materials, designs, and intellectual property developed by Tradelift remain the sole property of the company unless otherwise agreed in writing.

8. Termination

We reserve the right to suspend or terminate access to services if these Terms are violated, payments are overdue, or services are used unlawfully or unethically. Upon termination, all client data will be handled per our Privacy Policy.

9. Updates to These Terms

Tradelift may update these Terms from time to time. The latest version will always be posted with a revised “Last Updated” date. Continued use of our services signifies acceptance of any changes.

10. Governing Law

This Agreement shall be governed by the laws of the Province of Ontario and applicable federal laws of Canada.
